Uganda court refuses to revoke rebels’ bail

afrol News, 2 May - A Ugandan High Court judge, Justice Elidardi Mwangusya, dismisses the state's application to revoke the bail granted to suspected rebels of the Peoples Redemption Army (PRA), arguing that the court does not have the jurisdiction to review a case that has been decided by the Constitutional Court.

Earlier, the Constitutional Court ruled that it is to unconstitutional to continuously detain PRA rebel suspects. A High Court Judge, Edmond Lugayizi, granted them bail. The Constitutional Court therefore ordered their immediate release from detention.

The rebel suspects have been remanded at Nyamusherere and Arua government prisons before they were charged for murder.

Justice Mwangusya said the Constitutional Court did not overturn Justice Edmond Lugayizi’s decision to grant the suspects bail in December 2005.

Lucien Tibaruha, the Solicitor General, filed an application at the High Court in January, asking for a review of its decision to grant bail to the rebel suspects.

The Solicitor General’s application was supported by an affidavit sworn by a suspected rebel fighter, Captain James Katabazi. Mr Katabazi, who was granted amnesty last January, swore that the suspects would escape jurisdiction as soon as they were released from prison.
